Nintendo Successfully Takes Action Against R4 Cards

Australia, 19 February, 2010 –
 
Nintendo confirms it has successfully taken action against an Australian company in relation to game copying devices, commonly referred to as R4 cards. In September 2009 Nintendo filed proceedings in the Federal Court of Australia against RSJ. IT Solutions Pty Ltd which trades as “GadgetGear” – an online seller of gadgets, including gaming consoles and accessories- and the individual directors of the company, Patrick Li and James Li.
 
GadgetGear and its directors have now acknowledged that game copying devices infringe both Nintendo’s copyright and Nintendo’s trademarks and that they are illegal circumvention devices. As a result, GadgetGear and the directors have agreed to permanently refrain from importing, offering for sale and/or selling game copier devices. GadgetGear and the directors will also pay Nintendo a total of A$620,000.00 by way of damages. GadgetGear will also be delivering to Nintendo all its stock of game copiers for destruction.
 
Nintendo guards its intellectual property rights in order to protect the interests of its valued consumers, its own interests, and others in the games industry including independent content creation organisations, developers and publishing studios and all distributors of Nintendo products. Nintendo will pursue those who attempt to jeopardise the gaming industry by using all means available to it under the law. In particular, Nintendo is currently contemplating bringing further actions against other sellers of game copying devices in Australia.
 
Since 2008, Nintendo has pursued over 800 actions (including customs seizures, law-enforcement actions and civil proceedings) in 16 countries, confiscating well over a half million Nintendo DS game copiers. Piracy not only affects sales, it affects the price of video games and employment in the video game industry. Fewer sales of Nintendo’s hardware and software systems means fewer resources that Nintendo, its licensees, developers and publishers have to create and market new video game products which is ultimately to the detriment of video game enthusiasts. When there is a decrease in game development, there is also a decrease in the number of jobs in the industry.
 
The existence of piracy jeopardises the strength of the video game industry overall.

Rocket Racing delayed until March 11th for being “too awesome”

February 19th, 2010 – The hotly anticipated PS3 and PSP minis title Rocket Racing – rated E for EVERYONE, scheduled for release on February 18th, has been unexpectedly delayed. Halfbrick regrets these unfortunate circumstances, however due to Rocket Racing having a current rating of 9500 on the Kevin Bacon Awesomeness Meter (also known as K-BAM), the PlayStation servers were not equipped to take on such a powerful game at this time.

Rocket Racing Team leader Luke Muscat mentioned that the level of awesome was a risk, but one that was necessary for the quality of the game.

“Regular levels of awesome just weren’t cutting it. I have been having sporadic doses of awesome multiple times a day for years now, and frankly I am desensitized. As a result, I decided to tread a thin line somewhere near the very edge of maximum awesome, and death by awesome overdose.”

“Shattered Horizon’s space setting allows us to create stunning environments unlike anything you will find in other FPS games,” said Jaakko Haapasalo, producer at Futuremark Games Studio. “The free Moonrise pack doubles the number of levels in the game with each one offering a different zero gravity combat experience.”

In Shattered Horizon, a catastrophic explosion on the Moon has filled near-Earth space with billions of tons of rocky debris. Teams of players fight in zero gravity to control the limited supplies that mean the difference between survival and death in the cold of space. The Moonrise content pack includes four new levels set around the shattered Moon, taking the fight deeper into space and showing a new side to the conflict. The levels, listed in the order they appear in the trailer, are as follows:

The M-75 COMSAT microwave communication dish kept transmitting throughout the massive destruction on the Moon, its systems failing only after backup battery power was depleted. The logs contain classified information of MMC operations that must not fall in ISA’s hands.

Built in 2041, the Ten Star Hotel was a symbol of the wealth amassed by the oligarchs of the Moon mining business. A layer of golden radiation shielding covers what used to be the tower’s upper structure. The opportunistic crew of an ISA scouting mission decide to collect some souvenirs – only to run into MMC scavengers already looting the ruins.

MINOTAUR, an MMC orbital recovery vehicle survived the Moon catastrophe unscathed. Too valuable to risk in combat, it performs salvage and recovery missions behind the front lines. The ISA sets up operation Theseus to lure the ship into an obstructed space and knock it out.

Mass driver transportation was the key to commercial logistics between the Moon and Earth.
